India Pathology Dataset Usage Agreement for Research and Public Benefit


This Data Usage Agreement ("Agreement") is entered into by and between the User/Research Institution/Organization ("Recipient") and IIIT Hyderabad ("Provider") regarding the use of pathology image data for research purposes, collaboration, and public benefit.

1. Purpose

The purpose of this Agreement is to facilitate the use of India pathology dataset (IPD) solely for research, collaborative projects, and initiatives aimed at promoting public welfare and societal advancement. Recipient intends to utilize the data for scientific research, development of medical technologies, advancement of healthcare practices, and other endeavors that contribute to the common good.

2. Data Provided

Provider agrees to provide access to pathology image data in the possession of Provider, subject to the terms and conditions of this Agreement. The data provided may include but is not limited to:

  • Histopathology slides
  • Cytology images
  • Immunohistochemistry (IHC) images
  • Other pathology imaging modalities

3. Collaborative Projects

Recipient may engage in collaborative projects involving the use of the provided data. Any independent investigator from a separate institution involved in the use of the data is required to submit a separate request to the Provider for access to the data. Recipient shall ensure that all collaborators comply with the terms and conditions of this Agreement.

4. Restrictions

The recipient agrees to use the provided data exclusively for research purposes and initiatives aimed at promoting public benefit. Recipient shall not use the data for any commercial purposes, including but not limited to marketing, or sale of services. Recipient shall not create another source or repository of the provided data or share the data through any other means without prior written consent from the Provider. Recipient shall not attempt to re-identify any individuals from whom the data originated. Recipient shall take all necessary precautions to safeguard the privacy and confidentiality of the individuals whose data is included in the dataset.

5. Data Security

The recipient agrees to implement appropriate technical and organizational measures to ensure the security and integrity of the data. This includes but is not limited to encryption, access controls, and regular audits to prevent unauthorized access, disclosure, or alteration of the data.

6. Acknowledgment and Publication

Recipient agrees to acknowledge the source of the data in any publications, presentations, or other forms of dissemination resulting from the use of the data. Recipient shall provide proper attribution to the Provider in all such instances. A sample acknowledgment statement for the dataset is as follows: "The results published here are in whole or part based upon data generated by India Pathology Dataset Consortium managed by IIIT Hyderabad. Information about IPD can be found at https://hai.iiit.ac.in/ipd". Cite any publication related to specific data.

7. Ownership

Provider retains ownership of the data. Recipient acknowledges that the data provided under this Agreement remains the property of the Provider and agrees not to claim ownership or intellectual property rights over the data.

8. User Registration Privacy Statement

By registering to access the data, the Recipient agrees to provide accurate and current information and to maintain the confidentiality of their account credentials. The recipient's personal information will only be used for the purpose of managing access to the data and will not be shared with third parties without consent, except as required by law.

9. Duration and Renewal

This Agreement shall be valid for a period of one year from the Effective Date. At the end of the term, the Recipient must submit a new application for data usage, subject to the approval of the Provider.

10. Termination

Data Provider may terminate this agreement and immediately revoke access to all datasets at any time if the Requester is found to be no longer in agreement with the policies, principles, and procedures outlined in this Agreement.

11. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the Republic of India, and the courts of Hyderabad, India, shall have exclusive jurisdiction over any disputes that arise.
